Sustainability certification according to the Renewable Energy Directive 2018/2001 (RED II)

The recast of the Renewable Energy Directive 2009/28/EC by the Renewable Energy Directive (EU) 2018/2001 has led, among other things, to new European legal requirements for sustainability and greenhouse gas reduction targets for the promotion of electricity generation and biofuel production from biomass.

EU member states were required to implement the new regulations by June 30, 2021, and voluntary systems were required to adapt their system specifications to meet the new requirements.

This has been done by new regulations within the framework of a coat regulation, whereby the European requirements are implemented 1:1.
For the national implementation of the Directive (EU) 2018/2001 of 11 December 2018 on the promotion of the use of energy from renewable sources, the Biofuel Sustainability Regulation (Biokraft-NachV) in the version of September 30, 2009 (BGBl. I p.3182) as well as the Biomass Electricity Sustainability Regulation (BioSt-NachV) in the version of July 23, 2009 (BGBl. I, p.2174) have been replaced by the Biokraft-NachV in the version of December 2, 2021 (BGBl. I p.5143) as well as the BioSt-NachV in the version of December 2, 2021 (BGBl. I p.5126). The national regulations are valid since 08 December 2021.

The following should be noted:

The validity and duration of certificates issued under the Renewable Energy Directive 2009/28/EC is maintained.

Biomass that was considered as sustainable prior to July 1 and is handled according to the requirements of the voluntary schemes will continue to be treated as sustainable.

Proofs of sustainability that are issued in Nabisy prior the entry into force of the new version of the sustainability regulations remain valid.
The previous recognition of certification bodies will remain in effect until further notice.

The European Commission informs on its official website that it has recognized the first voluntary schemes for certifying the sustainable production of biofuels, bioliquids and biomass fuels under RED II by verifying that they comply with the EU sustainability criteria.

The implementing decisions on the recognition of the voluntary systems for demonstrating compliance with the requirements set out in the Directive have been published in the Official Journal of the European Union, where they can be found.
